Divorced mom of five may challenge RIAA

After years of intimidation and extortion, someone is finally standing up to the RIAA. In February, Patricia Santangelo was sued by several record companies in U.S. District Court. They claim that her home computer and internet account were used to trade copyrighted music. Their assertion is that people like Ms. Santangelo are destroying the music industry.

Of the roughly 13,300 similar lawsuits filed by RIAA record companies, none have gone to trial. Yet. But if Ms. Santangelo goes to trial, then this is huge. It will set a very important precedent.

Ms. Santangelo's lawyers have set up a blog to collect evidence and take input on these lawsuits

As I see it, she has two big problems:

1. Running out of money and

2. Finding a court with a working brain.

The RIAA deserves to lose, but they will probably be able to $$$ a verdict in their favor.

Too bad.

1. Take a look at the transcript of the May 6th hearing, and I think you'll see that Judge Colleen McMahon has quite a good brain, and quite a good heart as well. The transcript is posted on http://recordingindustryvspeople.blogspot.com

2. Take a look at the copyright statute and you'll see that the Court can award the winning party (in this case it will be Ms. Santangelo) attorneys fees.
